FYI. In about 30 states, you can't hire contractors if they perform "services within the usual course" of your business. They must be employees. What does that mean? Photographers can't be contractors for photographers. Designers can't be contractors for designers. You get it. Me, a lawyer, hiring a photographer for brand photos? Great! Assuming that person has a photography business. Photographer hiring someone to edit client photos? Gray area. Throw me some hypotheticals. Let's discuss.

You award a contract or you contract them, but using the term “hire” can and should land you in hot water with state tax depts, labor boards and the IRS. Use contract language for 1099, employment language for employees. And make sure you do NOT pay contractors with the same payroll system as employees. They should be paid through the AP system.
