I would find this annoying, carelessly getting in your son's space and what if he accidentally touches your son, he should be more considerate. He can sit like that but with more space. Also is this a bench? It's strange that a stranger joins on a bench unless it's very wide to allow many groups together

If you are not in Japan, this situation is not offensive. It will be rude to expect people to not sit next to you if there is a space for more people to sit on the same bench. So that means that you will be considered rude if you won't allow others to sit next to you if there is no reason why person shouldn't sit.
