So I have an important question. If I’m pregnant and I’m a US citizen, but my husband isn’t, will my baby be getting the US citizenship or not ? I’m so confused with all of these new laws.

You are a US citizen so therefore your baby is a US citizen.

YES You are a US citizen, your baby will be a US citizen also automatically. If neither of you are US citizens, if the baby is born within the land of the US, it used to be automatic that your baby gets a US citizenship (birthright citizenship) but Trump said he’ll ban it after sometime next month. Therefore, there won’t be “anchor babies” anymore.

It is not a new law nor it hasn’t even been approved by the two houses of Congress to stop Birthright Citizenship for children of illegal immigrants . It’s an Amendment (14th Amendment). In order to ratify a Constitution Amendment it will need 3/4, in other words 38 out of the 50 States to ratify the 14th Amendment after been approved by the two houses of Congress.

My mum is from NZ and dad from NSW. I was born in QLD, so according to Australian law, I am an Australian Citizen by birth. If the blonde carrot doesn’t change anything, your child would be a US Citizen by birth.
